Summary:
Explains different types of annuities, reviews taxation advantages of annuities, and addresses Federal and State roles in regulation of annuities. Outlines SEC-approved rule 151A, to reclassify equity-indexed annuities to be a security product as well as being an insurance product for tax purposes, and thus expand SEC oversight over these annuities. Analyzes arguments against SEC rule; and summarizes related legislation introduced in the 111th Congress, including H.R. 2733 and S. 1389, both the Fixed Indexed Annuities and Insurance Products Classification Act of 2009; H.R. 4173, the Wall Street Reform and Consumer Protection Act; and S. 3217, the Restoring American Financial Stability Act.
