Summary:
Discusses legislative history and establishment of presumptive service connection designation for veterans claiming VA disability compensation, which relieves certain veterans of burden to prove that their disability or illness was incurred during service. Reviews P.L. 102-4, the Agent Orange Act, which established presumption of service connection for diseases associated with exposure to Agent Orange and other herbicides; and suggests implications of process established by P.L. 102-4 for future presumptive service-connected determinations. Examines current challenges in making evidence-based determinations of presumptions, and presents policy options for Congress.
