Summary:
Discusses 2004 SEC rule requiring hedge fund advisers to register with SEC under the Investment Advisers Act, and the D.C. Court of Appeals decision that struck it down. Examines exemptions used by hedge funds under the Investment Advisers Act and the Investment Company Act. Discusses Title IV of the Dodd-Frank Wall Street Reform and Consumer Protection Act, which will create new registration and reporting requirements for private fund advisers.
