- Discusses 2004 SEC rule requiring hedge fund advisers to register with SEC under the Investment Advisers Act, and the D.C. Court of Appeals decision that struck it down. Examines exemptions used by hedge funds under the Investment Advisers Act and the Investment Company Act, and proposals to amend these laws to require registration of hedge funds with SEC. Highlights proposals for reform, including Obama Administration White Paper, Title IV of the Private Fund Investment Advisers Registration Act of 2009; H.R. 4173, the Wall Street Reform and Consumer Protection Act of 2009; H.R. 3818, the Private Fund Investment Advisers Act of 2009; H.R. 711, the Hedge Fund Adviser Registration Act of 2009; S. 1276, the Private Fund Transparency Act of 2009; and S. 344, the Hedge Fund Transparency Act; all to require registration of hedge funds with the SEC.
