- Summary:
- Examines Boumediene v. Bush, in which the Supreme Court held that aliens designated as enemy combatants and detained in Guantanamo Bay, have the constitutional right to habeas corpus; and that Section 7 of the Military Commissions Act, which limits judicial review of executive determinations of the petitioners' enemy combatant status, does not provide an adequate habeas substitute, and therefore is unconstitutional. Analyzes major implications for detention of alien enemy combatants and legislation that limits detainee access to judicial review.
