Summary:
Provides background on U.S. implementation of the Vienna Convention on Consular Relations, which stipulates that detained or arrested foreign nationals must be informed without delay of their right to have their consulate notified. Examines recent Supreme Court rulings in the consolidated cases of Sanchez-Llamas v. Oregon and Bustillo v. Johnson, concerning the type of judicial remedy available to foreign nationals in U.S. criminal proceedings who were not provided with requisite consular information; and addresses unresolved issues.
