- Provides overview of the Federal material witness statute, which authorizes the arrest of material witnesses, permits their release under the same bail laws applicable to Federal criminal defendants, and favors their release after their depositions have been taken. Reviews H.R. 3199, Section 12 of the USA PATRIOT and Terrorism Prevention Reauthorization Act, which requires a periodic review and report on the use of the material witness statute; and S. 1739, to set detention time limits and raising evidentiary standards for arrest and detention.
