Summary:
Discusses the history of Federal railroad rights of way grants, the various forms such grants have taken, and provisions enacted by Congress to govern the disposition of railroad rights of way. Covers the legal nature of rights of way, conveyances by railroads, provisions of the Rails to Trails Act, and Fifth Amendment takings cases regarding whether the retention of non-operating railroad rights of way for use as recreational trails constitutes a taking entitling the landowners to just compensation.
