- Describes and analyzes provisions of S. 354, the Help Efficient, Accessible, Low-Cost, Timely Healthcare (HEALTH) Act of 2005, to institute restrictions on medical malpractice litigation in Federal and State courts, including a cap on noneconomic and punitive damages awarded to plaintiffs; elimination of joint and several liability in health care lawsuits; reduction of damage awards by amount covered under collateral sources; limitations on lawyers contingent fees; creation of a Federal statute of limitations for medical malpractice suits; processes for periodic payment of future damages; and restrictions on the use of expert witnesses in health care lawsuits.
