- Discusses employment related issues when a business files for bankruptcy under the U.S. Bankruptcy Code, as amended by the Bankruptcy Abuse Prevention and Consumer Protection Act. Reviews provisions in the U.S. Bankruptcy Code governing the priority of employee wage and benefit claims, including severance payments; and describes procedures for a chapter 11 debtor to modify benefits under a collective bargaining agreement, as well as procedures for a chapter 11 debtor to modify retiree life and health insurance benefits. Examines employee representation on creditor committees, procedures in bankruptcy that facilitate lawsuits against an employer, and the treatment accorded aspects of managerial compensation, such as retention bonuses.
