- Discusses provisions of the Native American Graves Protection and Repatriation Act (NAGPRA), clarifying the ownership of Native American remains and artifacts found on Federal or tribal lands, and directing Federal agencies and museums to identify the origins of objects in their possession and to return ancestral remains and artifacts to appropriate Native American groups upon request. Examines impact on NAGPRA of Ninth Circuit U.S. Court of Appeals 2004 decision in Bonnichsen v. United States, known as the Kennewick Man decision, which found that certain pre-Columbian human remains discovered on Federal lands in Washington State are not subject to NAGPRA provisions because the remains bear no significant relationship to a presently existing Indian tribe.
