- Provides background on and explains safe harbor provisions of the Digital Millennium Copyright Act (DMCA) for online service providers (OSPs) and Internet service providers (ISPs), under which OSPs and ISPs are exempt from liability for copyright infringements by their users under certain conditions. Describes eligibility threshold for safe harbor, and examines issues relating to DMCA provision permitting copyright owners to obtain subpoenas requiring OSPs and ISPs to disclose the identity of alleged copyright infringers.
