Smits (Maastricht U., the Netherlands) does not provide an overview of recent discussions of the aims, methods, and organization of legal scholarship, but a sometimes personal account of doing academic work in the field of law. He argues that legal scholarship should primarily deal with what people and organizations are legally obliged to do. This question cannot be answered by reference to national legislation or case law, he says, but must be based on arguments derived from other sources. He covers a typology of legal science, towards a redefinition of normative legal science, methodology for normative legal science, and the organization of the legal-academic discourse.
