- Based on the author's doctoral dissertation submitted to Erasmus School of Law in Rotterdam, this book provides a law and economics analysis of the EU's European Emissions Trading Scheme (ETS) and the European legislation that has established it. The book begins by reviewing the institutional setting within which climate change legislation and emissions trading has emerged, with special focus on the Kyoto Protocol, within the context of the broader scientific and economic debate about climate change mitigation costs and policies. The author then presents a taxonomy of the legal rules and economic instruments that can address environmental problems and climate change. The author argues that the ETS may not be enough to ensure compliance with the goals set out by the Kyoto Protocol. The book is for scholars and policy makers in environmental law and economics.
