Appointment of Hon. Henry D. Clayton as a Senator from the State of Alabama. Had the Governor of Alabama, after the adoption of the seventeenth amendment, the constitutional power to appoint the Hon. Henry D. Clayton as the successor of Senator Joseph F. Johnston "until the next meeting of the legislature," under paragraph 2 of section 3 of Article 1 of the Constitution, relating to vacancies in the Senate, which provides that "If vacancies happen by resignation or otherwise during the recess of the legislature of any state the executive thereof may make temporary appointments until the next meeting of the legislature, which shall then fill such vacancies"?
